Introduction

At Mazala Pizza Corporation LLC, referred to as “Company,” “Mazala Pizza,” “us” or “we,” we recognize that your privacy is important. This Policy discloses the privacy practices for www.mazalapizza.com, our online ordering pages, and the Mazala Pizza mobile app, collectively the “Site,” as well as related products and services we may offer to you, including online ordering, pickup and delivery, and the Mazala Club, collectively referred to as the “Services.”

By accessing or using our Site, you agree to be bound by this Policy.

We reserve the right to change this Privacy Policy from time to time. We will notify you about significant changes by sending a notice to the primary email address specified in your account, placing a prominent notice on our Site, and updating any privacy information on this page. Your continued use of the Site and/or Services after such modifications will constitute your acknowledgment of the modified Policy and your agreement to abide by it.

IMPORTANT: By using the Site and/or offerings available on this Site, you give your consent that all personal data you submit may be processed by us in the manner and for the purposes described below. If you do not agree to this Policy, do not use the Site.

1. Types of Information We Collect

In order to better provide you with the Services offered by Mazala Pizza, we collect two types of information about our users: Personally Identifiable Information, or “PII,” and Aggregate Information.

Personally Identifiable Information: This refers to information that lets us know the specifics of who you are. When you engage in certain activities on this Site, such as placing an order, creating an account, joining the Mazala Club, applying for a job or franchise opportunity, or sending us feedback, we may ask you to provide certain information about yourself.

Examples of PII may include your first and last name, email address, telephone number, delivery address, zip code, preferred restaurant location, order history, and other identifying information. When ordering products on the Site, you may be asked to provide a credit or debit card number.

Aggregate Information: This refers to information that does not by itself identify a specific individual. We may gather certain information about you based upon where you visit on our Site and what other sites may have directed you to us. This information may include the URL of the site you came from, which URL you go to after visiting our Site, what browser or device you are using, and your IP address.

2. How We Collect and Use Information

We do not collect any PII about you unless you voluntarily provide it to us. However, you may be required to provide certain PII when you elect to use certain products or services available on the Site. These may include placing an order for pickup or delivery, creating an account, signing up for the Mazala Club, entering a contest or giveaway, submitting a contact, catering, careers, or franchising form, or submitting payment information.

Online orders and payments are processed by our ordering and payment provider, Toast, using encrypted SSL/TLS connections in order to prevent your PII from being stolen or intercepted. Your full credit card information is never stored on our servers.

We primarily use your PII to prepare, fulfill, and deliver your orders and to provide our Services to you. We may also use PII to improve our Site, marketing, promotions, menu and service offerings, customer experience, order confirmations, administrative notices, dispute resolution, troubleshooting, and enforcement of our agreements.

We may also collect, or our third-party advertising and analytics partners such as Meta/Facebook may collect, certain Aggregate Information. For example, we may use your IP address to diagnose problems with our servers, administer our Site, and gather demographic information.

3. Cookies

Depending on how you use our Site, we may store cookies on your computer or device in order to collect certain aggregate data and customize certain aspects of your user experience. Cookies may help us monitor aggregate site usage, remember your cart and preferred location, store login information if permitted, remember account and advertising preferences, and personalize the Services available to you.

We use advertising and analytics tools, including the Meta/Facebook Pixel, which may place a separate cookie or similar technology on your device to measure the effectiveness of our ads and show you relevant Mazala Pizza ads on other platforms. We do not provide third-party advertising partners with your payment information.

Most browsers are initially set to accept cookies, but you can reset your browser to refuse cookies or indicate when a cookie is being sent. Some aspects of the Site, such as online ordering, may not function properly if cookies are disabled.

4. Release of Information

We will not sell, trade, or rent your PII to others. We may provide some products and services through contractual arrangements with affiliates, franchisees, service providers, partners, and other third parties, referred to as “Service Partners.” We and our Service Partners may need to use some PII in order to perform services, process payments, deliver orders, provide customer service, and fulfill your requests.

The use of your PII by Service Partners is governed by their respective privacy policies and is not subject to our control. Other sites accessible through this Site, including ordering platforms, third-party delivery apps, social media pages, and Advertising and Service Partners, may have their own privacy policies. We are not responsible for the policies or practices of third parties.

We may be required by law enforcement or judicial authorities to provide PII to appropriate governmental authorities. We may disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation. We also reserve the right to report activities we believe in good faith to be unlawful.

We may provide Aggregate Information about customer sales, traffic patterns, and related Site information to third-party advertisers, but these statistics do not include Personally Identifiable Information.

5. Updating and Correcting Information

We believe you should have the ability to access and edit the PII you have provided to us. You may change your PII in your account or correct your personal information and privacy preferences by emailing or writing us at:

Please include your name, address, and/or email address when you contact us. You may ask to have the information on your account deleted or removed; however, some information, such as past transactions, order records, or backup data, may not be deleted completely.

6. User Choices on Collection and Use of Information

We may send you email or text messages regarding menu items, promotions, and offers that may interest you. If you do not want to receive solicitations from us, you can opt out at any time by clicking the unsubscribe link in a marketing email, replying STOP to a marketing text message, editing your account preferences, or contacting us at jay@mazalapizza.com or admin@mazalapizza.com.

You also have choices regarding cookies. By modifying your browser preferences, you can accept all cookies, be notified when a cookie is set, or reject all cookies. If you reject all cookies, parts of our Site may not work properly.

7. Security of Your PII

We strive to keep your PII secure, consistent with current industry standards, and to take appropriate security measures to protect against unauthorized access, alteration, disclosure, or destruction of your PII.

• We use encryption to help protect PII when it is transmitted to us.
• We keep collected information only for as long as reasonably necessary.
• We limit access to PII to employees, contractors, and agents who have a reasonable need to access it.
• We and our service providers use physical, electronic, and procedural safeguards, including encryption, firewalls, and password protection.
• Access to your account is available through a password selected by you. We recommend that you do not share your password.

Credit card transactions and order fulfillment are handled by established third-party payment processors, ordering platforms such as Toast, and delivery partners. They receive the information needed to verify and authorize your payment and process or deliver your order.

No data transmission over the Internet or wireless network can be guaranteed to be 100% secure. While we strive to protect your PII, you acknowledge that security and privacy limitations inherent to the Internet are beyond our control.

8. Miscellaneous

Our Site is not directed to children under the age of 13, and we do not knowingly collect, use, or disclose PII about minor visitors. If you believe a child has provided us with PII, please contact us and we will delete it.

You should also be aware that when Personally Identifiable Information is voluntarily disclosed in reviews, comments on social media pages, or other public areas, that information can be collected and used by third parties and may result in unsolicited messages. Such activities are beyond our control and this Policy does not apply to such information.

9. Your California Privacy Rights

If you are a California resident, the California Consumer Privacy Act, as amended by the California Privacy Rights Act, together the “CCPA,” gives you certain rights regarding your personal information.

Personal Information We Collect

We do not collect sensitive personal information for the purpose of inferring characteristics about you. We retain each category only for as long as reasonably necessary for the purposes above, or as required by law.

Disclosures, Sales and Sharing

We disclose personal information for business purposes to our Service Partners, including ordering and payment providers, delivery partners, franchisees and restaurant locations, and IT and customer service providers. We do not sell your personal information for money. However, our use of advertising tools such as the Meta/Facebook Pixel may be considered “sharing” of identifiers and internet activity for cross-context behavioral advertising under the CCPA. We do not knowingly sell or share the personal information of consumers under 16 years of age.

Your Rights

Subject to certain exceptions, California residents have the right to:

• Know and access the categories and specific pieces of personal information we have collected about you.
• Delete personal information we have collected from you.
• Correct inaccurate personal information we maintain about you.
• Opt out of the sale or sharing of your personal information, including cross-context behavioral advertising.
• Limit the use of sensitive personal information, to the extent we use it beyond what the CCPA permits.
• Not be discriminated against for exercising these rights.

How to Exercise Your Rights

To opt out of sharing, you may also enable a Global Privacy Control, or GPC, signal in your browser, which we will treat as a valid opt-out request for that browser, or adjust your cookie settings as described in Section 3.

We will need to verify your identity before fulfilling a request to know, delete, or correct. You may use an authorized agent to submit a request on your behalf; we may require signed permission and may ask you to verify your identity directly. We will confirm receipt of your request within 10 business days and respond within 45 calendar days, which may be extended by an additional 45 days where reasonably necessary, with notice to you.

Financial Incentives

The Mazala Club and other promotions may offer discounts or rewards in exchange for your contact information. You may join or leave these programs at any time by contacting us or using the unsubscribe options described in Section 6. We estimate the value of your data as reasonably related to the value of the rewards offered.

“Shine the Light”

California Civil Code Section 1798.83 permits California residents to request, once per year and free of charge, information about the personal information we disclosed to third parties for their direct marketing purposes in the preceding calendar year.
